What Is Cartiva and What Does It Do?
Cartiva is a big toe joint implant and an alternative to toe fusion surgery. This technology uses a synthetic cartilage material that can replace the damaged cartilage surfaces of large, arthritic joints. Cartiva works by cushioning the two bones that make up the big toe joint while also allowing for flexion, rotation, and other movements necessary for normal appendage function. For hallux rigidus suffers, this means it may be possible to reduce pain and restore mobility without having to undergo traditional fusion surgery.
With Cartiva implantation, patients may once again be able to walk without difficulty and participate in physical activities with much less pain than before. It is important to note, however, that Cartiva may not totally eliminate hallux rigidus symptoms in all cases. In fact, for many patients who’ve undergone the surgery, the implant has resulted in more harm than good.
Cartiva Lawsuits for Defective Device Design
Many patients are filing lawsuits against Cartiva manufacturers due to implant failure and complications after surgery. Patients have experienced a range of issues for which manufacturers may be liable, including:
- Motion issues
- Post-operative pain
- Subsidence
- Infection (implant caving into the bone)
- Cysts
- Joint removal
- Implant fracture
- Osteolysis
As a result of Cartiva failure and associated complications with the implants, many people have suffered pain and required additional surgeries to remove these devices — leading some individuals to file defective medical device suits against the Cartiva makers. Such lawsuits seek compensation for losses related to Cartiva failure, such as lost wages resulting from inability to work due to reduced mobility and recovery time.
Recovering Compensation for Cartiva Failure
If you suffered harm from a Cartiva implant, you may be eligible to file a personal injury claim against Cartiva to recover compensation for revision surgeries, medical expenses, wage losses, pain and suffering, or any other damages caused by the product. In addition, compensation for income losses can cover any wages lost due to time spent away from work for medical appointments, surgeries, and/or recovery periods. Lastly, there can also be intangible losses awarded by the court in cases where long-term medical suffering has caused emotional anguish or a decrease in quality of life. A successful lawsuit may also require Cartiva manufacturers to reimburse plaintiffs for any attorney fees or court costs they incurred in the process.
It is important to consult an attorney early on if you think you have a valid claim because potential plaintiffs are often subject to statutes of limitations when filing a claim.
